By accessing this Platform, you (“User”, “you”, “your”) agree to our terms and conditions below. We understand that legal documents may be lengthy and boring, and more often than not, you may want to skip them. However, it is important that you read these terms carefully before using the Platform. By using this Platform, you agree to be legally bound by these terms. General Terms
These terms of use govern your access to and use of our website and mobile application (collectively, the “Platform”) and set out the legally binding conditions under which you may browse, register, or otherwise use the Platform to access our services. They apply to all “Users” of the Platform, including guest Users.
By using the Platform in any way, you acknowledge that you accept these terms of use and agree to comply with and be bound by them. You understand that violating any of these terms may result in your access to the Platform’s services being restricted, suspended, or revoked.
We may update these terms of use at any time by revising this page. You should check this page periodically to stay informed of any changes, as such changes will be binding on you. For existing Users, we will also notify you of amendments by sending a prompt through the mobile application.
If you do not agree to these terms of use, you must not access the Platform or use its services.
Services
This Platform enables Users to request a rider to order or pick up food, grocery items, over-the-counter drugs, medical consumables, and other health-related products (“OTC Pharmaceuticals”) from nearby restaurants, supermarkets, and pharmacies (“Services”).
The Platform offers a selection of restaurants, supermarkets, and pharmacies from which you can order your preferred meals, groceries, and OTC Pharmaceuticals, and have them picked up and delivered to you.
Burucart is not affiliated with, nor does it have any partnership with, these restaurants, supermarkets, or pharmacies. Our responsibility is limited to placing orders for food, grocery items, and OTC Pharmaceuticals on your behalf according to your instructions and facilitating their delivery. We operate the Platform and provide the technical tools to ensure this process functions smoothly. We do not take possession of any food, grocery item, or OTC Pharmaceuticals offered for sale, and Burucart is not a subsidiary or part of any of the listed restaurants, supermarkets, or pharmacies.
We do not control, and cannot guarantee, the existence, quality, or safety of the food, grocery items, or OTC Pharmaceuticals advertised. We make no warranties regarding the accuracy of offers from restaurants, supermarkets, or pharmacies, their ability to prepare meals or provide items as described, or the complete safety of the OTC Pharmaceuticals ordered.
Unlike our delivery services, we cannot guarantee that meals, grocery items, or OTC Pharmaceuticals ordered through this Platform will meet satisfactory quality standards, and any such warranties, whether express or implied, are disclaimed to the fullest extent permitted by law.
Accessing our Platform and the Services
We do not guarantee that the Platform or any of the Services will be continuously available, uninterrupted, or free from faults. Burucart will not be liable to any User if the Platform is unavailable at any time or for any duration, for any reason.
We also do not guarantee that the Platform or any content on it will be completely free of errors or omissions.
You are responsible for making all necessary arrangements to access the Platform and ensuring that anyone who accesses the Platform through your User profile is aware of these terms of use and any other applicable terms and conditions, and that they comply with them.
Account Registration
Our Services are available only to individuals who are 18 years or older and who have the legal capacity to enter into binding contracts under applicable law. By using our Services, you confirm that you are at least 18 years old and that all registration information you provide is accurate and truthful.
Eligible Users must create an account as outlined below.
To create an account, you must provide your full name, email address, telephone number, and delivery address. A one-time password (OTP) will be issued upon registration. At this stage, you must tick a box to confirm your agreement with our terms of use and privacy policy.
You are solely responsible for keeping your login credentials confidential and must not share them with anyone. You will be held accountable for all activities and orders made using your login information. If your password or account is stolen, lost, or accessed without authorization, you must contact us immediately at support@burucart.com.
Payment
All payments on our Platform are processed through a third-party payment processor, which acts as a gateway for online transactions.
Orders can be paid for using the following methods:
- A closed-loop electronic wallet on the Platform, which can be topped up through available payment channels.
- Debit cards.
- Bank transfers.
- QR codes.
- Any other wallets offered on the Platform.
- Additional payment methods or channels provided by our payment service partners from time to time.
The payment processor is solely responsible for handling all payment transactions completed on the Platform.
The sale prices for meals, grocery items, and OTC Pharmaceuticals are displayed in the offers, shown in Naira, and include any applicable taxes.
The delivery fee is displayed on the checkout page.
The total price is stated at checkout and is payable when the order is placed.
By creating an account, you agree to be bound by these payment terms.
Intellectual Property
We and our Partners own all intellectual property rights in the Platform and any materials published on it. These rights are protected under applicable copyright laws in Nigeria, and all such rights are fully reserved.
We either own or are the licensor of all rights, titles, and interests in the Platform, including rights under patents, copyrights, design rights, trade secrets, and any other proprietary rights.
If you believe that any content on our Platform infringes your copyright, please contact us at support@burucart.com, and we will take steps to address the issue.
You acknowledge that the words and terms used to describe food menus and grocery items for the restaurants and supermarkets listed on the Platform were provided by Users who previously requested that we purchase these items on their behalf. Burucart is not liable for any inappropriate or inaccurate naming of food or grocery items. If you believe a food menu or grocery item has been incorrectly described, please contact us, and we will promptly take corrective action.
You also acknowledge that the words and terms used to describe OTC Pharmaceuticals for the pharmacies listed were provided by the pharmacies themselves. Burucart is not responsible for any inappropriate or inaccurate descriptions of OTC Pharmaceuticals. If you believe an OTC Pharmaceutical has been incorrectly described, please contact us, and we will take immediate steps to remedy the issue.
No Reliance
The content on our Platform concerning meals, grocery items, and OTC Pharmaceuticals is provided for general informational purposes only and is not intended as advice on which you should rely. While we take reasonable steps to keep the information on our website and application updated, we make no representations or warranties, express or implied, that the content is complete or current. You acknowledge that any reliance on such information is entirely at your own risk.
Limitation of Liability
Nothing in these terms of use excludes or limits our liability for personal injury caused by our negligence, fraudulent misrepresentation, or any other liability that cannot be excluded or limited under Nigerian law.
To the fullest extent permitted by law, we disclaim all conditions, warranties, representations, or other terms, whether express or implied, that might otherwise apply to our Platform or any content on it.
We do not assume responsibility for the content of websites linked to our Platform. Such links should not be interpreted as an endorsement by us, and we will not be liable for any loss or damage arising from your use of these linked websites.
As a User, please note that our Platform is provided solely for domestic and private use. You agree not to use the Platform for any commercial or business purposes without our explicit written consent. We are not liable for any loss of profit or business opportunity resulting from unauthorized commercial use of the Platform.
To the extent permitted by law, Burucart shall not be liable for any indirect, punitive, incidental, special, or exemplary damages arising from your inability to use our Services.
We are not responsible for any damage resulting from unauthorized use, tampering, or access to your Burucart account.
You agree that Burucart is not liable for any damages or losses arising, directly or indirectly, from:
- Delays or disruptions in our Services, software, or Platform;
- Your use of, or inability to access, our Services or Platform;
- Any suspension or other actions affecting your Burucart account;
- Access or use of our Services in a manner inconsistent with these terms, or from errors, inaccuracies, losses, or omissions in any data provided to us;
- Any damage caused by viruses or other harmful technological materials that may infect your devices through the use of our Platform or linked websites.
We will not be liable to any User for any loss or damage, whether arising from contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, in connection with the use of or inability to use our Platform.
Indemnification
You agree to indemnify, defend, and hold Burucart harmless from any loss, damage, liability, or claim arising from or related to your:
- Use or misuse of our Services;
- Use or misuse of the OTC Pharmaceuticals being delivered; and
- Breach of these terms of use or any applicable law.
We reserve the right, at your expense, to take exclusive control and defence of any matter for which you are required to indemnify us, and you agree to cooperate fully with us in defending such claims.
Duration and Termination
These terms of use take effect from the date you begin using our services and will remain in force until terminated either by you, through the closure of your account, or by us.
Restricted Activities
Our Platform may only be used for lawful purposes. You must not, and must not permit anyone else to use it for any purpose other than the intended use for which it was made available.
As a User of our Services and Platform, you agree not to use them:
- In any manner that violates applicable laws or regulations;
- In any way that is unauthorized by us or that may harm or be detrimental to us;
- For any fraudulent purpose or activity, including providing false identification; or
- To modify, adapt, decipher, disassemble, or reverse engineer any software that forms part of our Platform.
Digital Communication
By accessing and using our Services, you consent to receiving communications electronically. All notices, disclosures, and other communications sent to you via email or displayed on our Platform will satisfy any legal requirement for written communication.
You agree to the use of electronic signatures, contracts, orders, and other records, as well as the electronic delivery of records for transactions you initiate or complete. You waive any rights under applicable law that require an original signature or the delivery or retention of non-electronic records.
Severability
If any provision of these terms of use is found by a competent authority to be invalid, unlawful, or unenforceable in any way, that provision will be severed to the extent necessary, and the remaining terms, conditions, and provisions will continue to be valid and enforceable to the fullest extent permitted by Nigerian law
Personal Data
The company collects and processes the personal data of its Users. For more information on how your data is used and processed, we encourage every User to read the Platform’s “Privacy Policy.” For clarity, except for our payment providers, we do not share your personal information with any other third parties.
Sanctions for Breaches
In the event of fraud, a breach of these terms of use, or a violation of applicable laws or regulations, we reserve the right to take appropriate actions, including but not limited to:
- Suspending or terminating the User’s access to all or part of the services; or
- Notifying the relevant authorities and pursuing legal action.
Any suspension or termination will take effect immediately on the date we notify the User, and the User’s account will be automatically deleted without further notice.
Order Placement
The images of products displayed on our Platform may be stock photographs used for illustrative purposes only. While we make every effort to ensure accuracy, actual products may vary.
The order page and all communications related to your order will be in English. The order page allows you to place your order, review it, and make any necessary corrections before confirmation.
The order page leads to the checkout page, where you confirm your order. By confirming, you agree that all corrections have been made.
To place an order, you must select a restaurant, supermarket, or pharmacy and choose items from the lists provided on the Platform’s homepage.
If your preferred restaurant, supermarket, or pharmacy is not listed, you may contact us to request a listing. However, we are not obligated to add any recommended restaurants, supermarkets, or pharmacies to the Platform.
Users can view a summary of their order at the checkout page before confirmation. Confirming an order constitutes an offer to enter into a contract to purchase the selected meals, grocery items, or OTC Pharmaceuticals. Any order cancellations must be made before the restaurant or pharmacy accepts the order; once accepted, cancellations are no longer possible.
The Platform also provides a tool that summarizes your orders and payment history, which you can access at any time.
Order Fulfilment
The delivery of your meal, grocery items, or OTC Pharmaceuticals is carried out directly between you and Burucart.
You are responsible for accepting delivery of all items you order through the Platform.
If any part of your order is not received, you must contact Burucart’s customer service immediately. In such cases, the order will be delivered, and where appropriate, you may be refunded for the undelivered items.
Users expressly acknowledge that they cannot request a refund or delayed delivery for orders they fail to accept at the time of delivery.
It is your responsibility to ensure that all delivery details, including your address and phone number, are correct.
In the event of incorrect or mixed-up orders, you agree to contact Burucart immediately to request a return. The order must remain in its delivered condition and must not be altered in a way that prevents it from being returned to its original delivered state.
Customer Greviances
Users should submit any complaints to customer service by emailing support@burucart.com or using the in-app chat feature.
Disclaimer
The services are provided on an “As Is” and “As Available” basis. Burucart disclaims all representations and warranties, whether express, implied, or statutory, that are not explicitly stated in these terms. Burucart makes no claim of having any existing relationship, engagement, or commitment with any of the restaurants, supermarkets, or pharmacies listed on the Platform.
Additionally, Burucart does not guarantee the reliability, timeliness, quality, suitability, or availability of the Services, or any goods or services requested through the Services, nor does it guarantee that the Services will be uninterrupted or error-free. You acknowledge that any risk arising from your use of the Services, or from any goods or services requested through the Services, rests entirely with you, to the fullest extent permitted by applicable law.
Burucart also disclaims any responsibility as a medical provider. We are not medical practitioners, and our Services are strictly limited to the delivery of OTC Pharmaceuticals. We do not provide medical advice, diagnoses, or any other form of healthcare services.
The Services under these terms are limited to OTC Pharmaceuticals, and we do not provide Services for any drugs that require a prescription from a licensed medical doctor.
Discount Code
Burucart may, at its sole discretion, issue promotional codes that can be redeemed for discounts, features, or other benefits related to the Services, subject to any additional terms specified for each code (“Promo Codes”). You agree that Promo Codes:
- Must be used only for their intended purpose and in a lawful manner;
- Cannot be duplicated, sold, transferred, or made publicly available (including on public forums or otherwise);
- May be disabled by Burucart at any time, for any reason, without liability;
- Can only be used in accordance with the specific terms established by Burucart for that Promo Code;
- Are not redeemable for cash; and
- May expire before use.
Burucart reserves the right to withhold or deduct credits, features, or benefits obtained through Promo Codes if it determines or believes that the use or redemption of a Promo Code was in error, fraudulent, illegal, or in violation of the applicable Promo Code terms or these terms of use.
Applicable Law
These terms of use are governed by the laws of Nigeria. In the event of any dispute concerning the validity, interpretation, or enforcement of these terms, the parties agree to submit to the exclusive jurisdiction of the Nigerian courts.
